Three weeks ago I was riding my motorcycle with my 12 year old son on back. I was in the left lane with a truck in front of me, a car was on my right and the light just turned red. All three vehicles were approx 50 feet from the stop light.
The truck took the left turn lane and I proceeded towards the light when the car, on my right, decided to take my lane, forcing me to act. I was being forced into the truck on my left, by the car on my right. At that moment I was even with the driver's door. I released the throttle and shoved the car's mirror with my right hand to keep my motorcycle from hitting the car. The mirror broke. The driver stopped and I had just enough room, between the truck and the car, to pass the car and stop before entering the intersection.
I got off the motorcycle and proceded to give the driver my "YOU STUPID #%&*" speech. Because the vehicles didn't touch, there was no reason for me to stay, so I left.
Two days later I got a call from the local Police. Mr Owen said he was investagating an incident that involved my motorcycle and asked if I was involved. I answered a few questions and pissed him off not answering others. He stated that the driver said that I got off the motorcycle, walked back to the car, broke the mirror and began cussing. He stated also that if I were to pay for the broken mirror that the issue would be dropped. I told him that the the bitch could #$^& off and that I will not be paying for **** and gave him my address and told him that if he felt the need to arrest me I would be at home. 10 days later he came to my home with an arrest warrant for vandalism under $500.00 and took me to jail.
On the ride to jail I stated that the incident happened outside of his jurisdiction. The intersection where the incident happened was the town limits. Had the incident happend 20 feet farther up the road he would have jurisdiction. I was booked and jailed anyway. The next morning I was given a court date and released ROR.
On court day I was ready, but when the prosecutor asked the driver where the incident happened. She answered "South of the intersection". The judge and the prosecutor looked at each other and the judge dismissed for lack of jurisdiction.
Now I want revenge. The driver put my life, my son's life and my property in danger and lied to the officer about me breaking the mirror after I stopped and parked my motorcycle. Filing a false police report and endangering our lives and property. Civil and criminal charges for the driver should be made.
The cop that arrested me knew that the incident happened outside of his jurisdiction and arrested me anyway. "FALSE ARREST / FALSE IMPRISONMENT" charges should be made.
What are the proper charges? What is the proper proceedure for charging these persons? Where can I find information on how to do this?
