    Default New sign at pool

    I noticed a new sign at the pool where my daughter is taking swim lessons:

    "Open Carrying of a Firearm or any Unauthorized or Unlawful Possession of a Firearm is Prohibited"

    It is interesting that they posted this new sign to go along with the typical no weapons signs. Looks like the city is starting to take a stand against open carry. Anyways, thought I would post it for your information.

    If this is a private facility then it can be argued that the owners of the pool are taking on added liability.

    One of the firms that I occasionally process serve for has a partner who specializes in liability insurance cases. He said that many insurance companies ask policy holders not to post such signs since it can create a larger liability question for the policy holder and insurance companies.

    One guy in my gun club actually takes photos of such signs and then sends copies to the insured's insurance company. He never gets any replies from the companies but he states that the signs are usually removed within a few weeks (and this is in NY, deep behind the anti-2A lines, where guns are looked upon as evil things that only the military and police should possess.)

    It's a city pool. I don't really care as it doesn't apply to me but I did think that it was weird. I also get photos of these just in case I may need them.

    A firearm is a federally-regulated article in interstate commerce. You declare your gun, weapon, protection, S&W, etc. to be a "firearm" and the cops, prosecuting attorney, and judge will take your word for it.

    Otherwise they have to prove the fact, which if your "piece" is privately-owned and not for sale they probably can't.

    If you can keep your own lawyer from selling you down the road by using the same terminology, that is.

    Municipalities are different since they most likely are self insured for liability and most states shield municipalities from certain types of liability hence lots of municipalities can get away with such anti-2A behavior (hysteria?) unencumbered.
